Behind The Project (BTP, we, us, or our) is committed to protecting your privacy and handling your personal and commercial information in an open and transparent manner.

This Privacy Policy explains how we collect, use, hold, disclose, and otherwise handle your information when you access or use the Behind The Project website, platform, applications, and related services (together, the Services). We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Behind The Project is an AI-native contract analysis platform that allows subcontractors to upload construction contracts, scopes of work, annexures, and related documents to gain risk insights, generate negotiation drafts, and manage commercial agreements.

03. What Information We Collect

The information we collect depends on how you use the Services.

3.1 Information you provide directly

  • Your name, email address, and phone number;
  • Account login credentials;
  • Business or company name and ABN;
  • Commercial data contained in uploaded contracts, scopes of work, and project documents;
  • Payment and billing information required to manage subscriptions; and
  • Communications and correspondence with us, including support enquiries.

3.2 Information we collect automatically

When you use the Services, we may automatically collect device information, browser type, IP address, usage data, and analytics regarding how you interact with the platform.

04. How We Collect Your Information

We collect information when you register for an account, upload contract files (such as PDFs or Word documents), use the Services, contact support, or interact with our website.

Where reasonable and practicable, we collect information directly from you. If you do not provide certain information, some parts of the Services (such as AI analysis) may not function properly.

05. Why We Collect, Use and Hold Your Information

We use your information to provide, operate, and maintain the Services; create and manage your account; process uploaded contracts to generate insights and risk profiles; process payments; and comply with legal obligations.

5.1 AI Processing

BTP uses advanced AI tools and service providers—including Google Gemini—to deliver features such as clause extraction, risk identification, and negotiation drafting. To operate these features, we send the text of your uploaded contracts to our AI providers.

We limit the data shared to what is reasonably necessary. Data sent to our AI providers is processed via secure enterprise APIs, and your contract data is not used by these providers to train their general public models. However, AI-generated outputs are probabilistic and must be independently assessed by you before being relied upon for commercial decisions.

06. How We Handle Commercial Data

We understand the highly sensitive and confidential nature of construction contracts, tender documents, and commercial pricing. Your uploaded documents are used strictly to provide the Services to you.

We do not sell your personal information or your commercial contract data. We do not share your individual contract terms with competitors, main contractors, or third-party marketers.

07. Disclosure of Your Information

We may disclose your information to third parties where reasonably necessary, including to cloud hosting providers (e.g., Supabase), AI processing providers, payment processors (e.g., Stripe), and analytics providers.

We may also disclose information to regulators, courts, or law enforcement bodies where required by law, or to a purchaser in connection with a sale or transfer of our business.

08. Overseas Disclosure and International Data Transfers

Some of our service providers are located outside Australia, including in the United States. As a result, your information may be disclosed to, stored by, or processed by overseas recipients. We take reasonable steps to ensure overseas recipients handle the information in a manner consistent with Australian privacy laws through secure vendor agreements.

09. Data Security

We take reasonable steps to protect your information from misuse, interference, and loss, and from unauthorised access, modification, or disclosure.

These safeguards include encryption in transit (HTTPS / TLS), secure database hosting via Supabase (including row-level security so users can only access their own records), and restricted infrastructure access.

No method of transmission over the internet is completely secure. You are responsible for maintaining the confidentiality of your account credentials and employing appropriate security practices on your own devices.

10. Data Retention

We retain information only for as long as reasonably necessary to provide the Services, comply with legal obligations, and resolve disputes. If you delete your account, your authentication record and associated contract data will be removed from our active databases, though backups may persist for a short routine operational period.

11. Access, Correction and Other Privacy Rights

Under the Australian Privacy Principles, you have the right to access the personal information we hold about you and to request correction of inaccurate or out-of-date information.

Most of your information is visible to you directly within the platform. To make a formal privacy request or request account deletion, please contact us using the details below. We aim to respond to privacy requests within 30 days.

12. Complaints

If you have a complaint about how we have handled your personal information, please contact us. We will consider your complaint and respond within a reasonable period. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC).

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make a material change, we may notify you by email or through the Services. The updated version will take effect from the date stated at the top of this policy.
