01. About the Beta Programme
These Beta Programme Terms (Beta Terms) apply to your participation in any Behind The Project (BTP) beta programme, beta feature, or early access version of the Services (Beta Programme). These Beta Terms supplement and should be read alongside our full Terms of Service and Privacy Policy.
By participating in the Beta Programme, you agree to these Beta Terms. In the event of any conflict between these Beta Terms and the Terms of Service, these Beta Terms prevail to the extent of the inconsistency.
02. Nature of Beta Access
The Beta Programme provides early access to contract analysis features that are still under active development. You acknowledge that:
- The beta version is not complete and may contain bugs, errors, or unexpected behaviour in AI outputs.
- Features available during beta may be changed, removed, or significantly altered before general release.
- Data structures (like how clauses and scopes of work are mapped) may change during the beta period.
03. No Warranties
The beta Services are provided strictly "as is" without any warranties of any kind, to the maximum extent permitted by law. We make no representations regarding uptime, accuracy of AI contract extraction, data security, or the availability of any specific feature. This does not affect any non-excludable rights you may have under the Australian Consumer Law.
04. Data During Beta
4.1 Risk of Data Loss
During the beta period, your data may be reset, migrated, or otherwise affected by changes to our database structure. Data continuity between beta versions is not guaranteed.
4.2 Your Responsibility
Do not rely on BTP as your sole repository for construction contracts or tender documents. Always maintain your own accurate records independently of the platform.
05. Not Legal Advice
Nothing generated, displayed, or communicated by BTP during the beta period constitutes legal, commercial, tax, or financial advice. We are not a law firm. All AI-generated insights, risk scorings, and negotiation drafts are for informational purposes only. Always consult a qualified construction lawyer before signing commercial agreements.
06. Feedback and Improvements
As a beta participant, you may provide feedback, bug reports, and feature requests by emailing support@behindtheproject.com.au. By providing Feedback, you grant BTP a perpetual, irrevocable, worldwide, royalty-free licence to use, modify, and commercialise such Feedback without any obligation to you.
07. Confidentiality
The beta Services, including any AI prompting techniques, designs, or functionality not publicly announced, may be considered confidential. You agree not to disclose or share such confidential information with competitors or third parties without our prior written consent.
08. Access and Revocation
We reserve the right to revoke your access to the Beta Programme at any time, for any reason, without notice. When a feature transitions from beta to general release, your continued use will be governed by the standard Terms of Service.
09. Limitation of Liability
To the maximum extent permitted by law, Behind The Project's liability to you for any loss or damage arising from your participation in the Beta Programme is limited to AUD $0, given the early-access nature of the beta Services. This does not limit any non-excludable rights under the Australian Consumer Law.
